Terms of Service.

These Terms of Service (the "Terms") govern your access to and use of OBMX, including the obmx.app website, the OBMX desktop and mobile applications, and any services we provide (together, the "Service"). By creating an account, signing in with a third-party identity provider, or otherwise using the Service, you agree to be bound by these Terms.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" in these Terms refers to both you and that organization.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at security@obmx.app if you suspect unauthorized access.

You agree to provide accurate information during registration and to keep it current. We may suspend or terminate accounts that contain false information, are used to impersonate others, or violate these Terms.

Some features are offered on paid plans. Pricing, billing cycles, and included usage are described on the plan page at the time of purchase. Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel renewal at any time from your workspace settings; cancellations take effect at the end of the current period.

Free trials and free tiers may have feature, seat, or usage limits. We may modify or end a trial at any time. Refunds are handled on a case by case basis and are not guaranteed for partial billing periods, except where required by law.

You retain all rights to the content, files, and data you upload, create, or transmit through the Service ("Customer Data"). You grant OBMX a limited, worldwide, non-exclusive license to host, copy, transmit, display, and process Customer Data solely as needed to provide the Service to you and your organization.

You are responsible for the lawfulness of Customer Data and for obtaining any consents required from individuals whose data you upload (for example, employees, candidates, or contacts). You must not upload data you do not have the right to share.

You agree not to: (a) use the Service to violate any law or third-party right; (b) attempt to disrupt, reverse engineer, or probe the Service for vulnerabilities outside an authorized program; (c) upload malware or content that is unlawful, abusive, or infringing; (d) resell or commercially redistribute the Service without our written consent; or (e) use automated means to scrape data beyond what our APIs permit.

We may remove content or suspend access if we reasonably believe it violates these rules or puts other users at risk.

The Service may interoperate with third-party products such as identity providers (Google, Microsoft), payment processors, BIM platforms, and biometric devices. Your use of those services is governed by their own terms. We are not responsible for the availability, accuracy, or practices of third-party services, and an integration may change or end at any time.

We work to keep the Service available and reliable, but we do not guarantee uninterrupted operation. We may add, remove, or change features over time. For material changes that reduce functionality on a paid plan, we will give reasonable advance notice when practical.

You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you breach these Terms, if your use creates risk for OBMX or other users, or if required by law. On termination, your right to access the Service ends. We will provide a reasonable opportunity to export Customer Data before deletion, except where prohibited by law or where the account was terminated for cause.

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error free, secure, or meet your specific requirements.

To the fullest extent permitted by law, OBMX and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total aggregate liability for any claim arising from or relating to the Service will not exceed the greater of (a) the amounts you paid to us for the Service in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars.

You agree to defend and indemnify OBMX against claims, damages, and costs arising from (a) your Customer Data, (b) your violation of these Terms, or (c) your violation of applicable law or third-party rights through your use of the Service.

We may update these Terms from time to time. If a change is material, we will notify you by email or through the Service before it takes effect. Your continued use of the Service after the effective date of an updated version constitutes acceptance of the new Terms.

These Terms are governed by the laws of the jurisdiction in which OBMX is established, without regard to conflict of laws rules. Any dispute will be resolved exclusively in the competent courts of that jurisdiction, except where applicable consumer protection law gives you the right to bring proceedings in your local courts.
